The website www.diwanshamanspirit.com is owned by Diwan Basel, which is committed to protecting your privacy and takes all necessary precautions to ensure that your personal data is processed securely and in accordance with the law.  We therefore handle the personal data you voluntarily provide to us—and which may be processed—with great care and diligence.

1. THE REGULATION
Since May 25, 2018, the European Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data has been in effect.   The Regulation introduces clearer rules regarding the obligation to provide information and consent, defines the limits of automated processing of personal data, establishes the framework for exercising new rights, and sets forth strict criteria for transferring data to a country outside the EU and for cases in which personal data is misused.

If you provide your consent to processing for marketing purposes, the data you provide may also be combined with data from the following categories, which have been lawfully obtained from other sources:

  • Data collected when you browse Diwan’s websites or use our apps

  • Data related to the use of services, including financial services provided by Diwan’s partners

  • Statistical data

The following data is processed for marketing purposes:

  • Last name, first name, home address, email address, landline number, and cell phone number; list of purchased items or services.

4. PURPOSE OF PROCESSING
a) Purposes closely related to the processing of the order you placed, including, among other things, administrative and accounting purposes;

b) Sending questionnaires and surveys using automated methods (email, text message, etc.) and traditional methods (phone calls or mail) to measure customer satisfaction and conduct research on the quality and development of products and services;
c) the preparation of internal reports to improve corporate management and the products and services offered;

d) direct marketing and the sending of promotional material regarding Diwan Basel’s products and/or services, direct sales, commercial communications, invitations to events, contests, and promotional campaigns, using both automated methods (email, text messages, etc.) and traditional methods (phone calls or mail);

f) Development of products and services through the analysis of your data using modern techniques and the use of automated decision-making processes, including, in some cases, profiling.

The provision of your personal data to Diwan Basel is voluntary.
However, the lack of necessary data to fulfill our legal, pre-contractual, and contractual obligations may make it impossible for us to properly process your order or inquiry.

6. PROFILING
When we send you marketing communications, our goal is to provide you with advertisements, sales promotions, and offers that may be of interest to you. Your personal data that we use for marketing products and/or services
that may be of interest to you. The personal data we collect for the purpose of marketing Diwan Basel products and/or services allows us to create your profile in order to analyze, track, and anticipate your preferences and interests regarding our products and services.  Similarly, your data, combined with that of our other customers, enables us—through extrapolation, customized profiling, and the use of intelligent algorithms, to understand the use and success of our products and services and to improve them for the benefit of our customers.

In other words, a better understanding of your preferences allows us to better satisfy you.  Of course, we strive to collect only data that is closely related to our products and services.

7. RECIPIENTS
Your data may be disclosed to employees and staff of Diwan Basel acting as data processors, as well as to other third parties acting as data processors or independent data controllers (freelance service providers and/or external service companies that provide support, certification, consulting, controlling, marketing, data processing, IT services, or services for the press or call center management, or who specialize in market research, commercial communications, or the sending of notifications, etc.)be disclosed.  Your data may also be shared with third parties in accordance with legal obligations or following a court or administrative agency decision.

8. DATA TRANSFER
Your data is stored on servers located within the European Union (EU), where Regulation (EC) 2016/679 applies.  Diwan Basel also uses technological platforms to offer webinars (free online mini-courses) and relies on companies that comply with the so-called Privacy Shield, the agreement that governs data transfers between the European Union and the United States, protects the fundamental rights of individuals in the EU whose personal data is transferred to the United States, and establishes certain rules for companies that send data to the U.S.  In its decision of July 12, 2016, the European Commission recognized that the Privacy Shield provides adequate protection for personal data and therefore serves as a legal guarantee regarding data transfers.   It is possible that some of our vendors, partners, or independent contractors are located outside the EU and that your data is processed in countries outside the EU where the level of protection for personal data does not meet EU standards. In these cases, we ensure that data is transferred in compliance with the European General Data Protection Regulation by implementing security and precautionary measures to protect your data that are equivalent to those of the EU.  If you send a message to the contact information provided above, you can obtain more detailed information on this matter.

9. DATA RETENTION
Your personal data will be retained for:

  • 5 years from the date you fill out a form to receive marketing, promotional, and informational materials regarding Diwan Basel’s courses, services, and digital products.

  • 10 years from the date of purchase of the item or service for marketing purposes, to promote products and/or services from Diwan Basel.


With regard to the points listed above, Diwan Basel has a legitimate interest in knowing its customers’ preferences in order to better personalize its offerings and provide products and services that are better suited to its customers’ needs and desires. In this case, as a data subject, you may exercise your rights, as listed below, at any time.

  • 10 years from the date of purchase of the product or service for the purpose of safeguarding rights (e.g., the obligation to retain accounting records) related to the purchase.


10. YOUR RIGHTS
Under the Regulation, you are the data subject and are entitled to the rights provided for in Article 15 of the General Data Protection Regulation; specifically, you may request confirmation as to whether data concerning you is being processed, or obtain access to your data and information regarding the processing activities carried out by Diwan Basel.


You have the right to request the correction or deletion of your data, or to restrict the processing of your personal data. You may object to the processing of your data or withdraw your consent at any time. You may also request that your data be provided to you or to a third party in electronic form.

NEWSLETTERS AND OTHER ELECTRONIC COMMUNICATIONS
Diwan Basel sends a newsletter to users who have consented to receive it by signing up for the service or by filling out a registration or sign-up form, or a form to download materials from the website.

Through the newsletter, we send you information and useful resources about course content, instructors, and books we recommend.

This constitutes express consent, in accordance with the previous paragraph.

Explicit consent, as described in the previous paragraph, is deemed to have been given at the moment when, upon requesting data, Diwan Basel duly informs the user of the option to subscribe to the newsletter and the user has not declined this service.
